Maid contract

Well, not really sure why I post in this forum about this, but maybe some of you may be able to answer.

I have a "part time" maid (meaning she was fully employed during the week and came to clean my house the week end for extra cash) but she called me this morning saying that her employer terminated her contract just today (without notice) and asked if she could put her bags at my house and she'll sleep at her friends place.

Of course I accepted as it doesn't do me any harm.

But now she's asking me if I can "sponsor" her, meaning sign her a contract so she can stay in HK (otherwise she has to leave HK within 14 days). Told her I don't need a fulltime maid but she told me that I wouldn't have to pay her full time, just our usual part time rate.

As I never had a full time maid, not really sure of the implications for me. I'm ok to help someone but I don't wanna be hold as responsible for this person (meaning what happens if she has an accident or anything).

Does someone have any advice on this? What are the risks for me?

Full information is available on the immigration department website. But you are responsible for them, obligated to pay the minimum maid wage, flights home, medical care etc.

It is also illegal for the maid not to live with you and for them to have other employment. Although I don't know how strictly this is enforced.

I believe the requirement for live-in has changed -- DHs (I think) are now allowed to live outside their employers premises.  

However, the rest of what Dirty wrote is accurate.  You ARE her sponsor in HK and therefore are responsible for her, including a minimum salary (about 4K HK per month, plus room+board); one flight home a year, etc.  

If you are an ex-pat getting caught breaking HK's immigration laws will get you deported.  I wouldn't do it.  If you are a local you could face a big fine.  

I wouldnt do it.

Thanks for your advices, I'll follow them.

I'm sorry for her but I don't want to risk anything. Just hope she'll find a full time employer soon.

If you're a single male you need a cast-iron excuse to be allowed a maid, and that pretty much means you're divorced and got given custody of the kids - otherwise you'll get some very strange looks in Immigration.  They've seen it all.  

Having said that, I know some guys who do employ their girlfriend.  All the ones I know have their kids living with them.

It does make it frightfully complicated of course, you carry all the liability, potentially both civil and criminal penalties for naughtiness, and make yourself very vulnerable to the slightest feeling of jealousy or change of heart on her side.  

If you don't like being in the news, or want to sleep easy, best to avoid playing around with immigration laws.

Yes it is legal for a single male to hire a live-in DH, but as noted, you will go through a more serious vetting by Immigration.  I know a few mates who did this (hired their filly girlfriends as their DHs to get their visas).  (They all worked out badly incidentally.  One was hospitalized when his very jealous girlfriend bit his testicles during a fight.  Hehe.  They were in court suing each other for months.  Nasty! A second mate's gal got pregnant -- by someone else!!!  (he knows this because he was "fixed"  Poor sod.)).

It is a very bad idea.  Don't get HK Immigration involved in your sex life.

Pretty sure they still have to live-in, if not, I would assume you would have to pay their rent.

If she was terminated and her contract unfinished, she can't stay in the country. She can get a new employer in her remaining 14 days). but she would still have to leave the country and wait for her new Visa before coming back in. The only exceptions are if contract has finished or employers are leaving the country, or employer has died.

Single people can get a maid providing their accommodation is big enough, or they have duties such as looking after children, looking after old people, or looking after pets. I know a few who have maids to help look after their reasonably sized apartments with dog.

Thanks for your advice. Told her I wouldn't risk it and she understood. She'll go back to her country and try to find a new contract.

Was just looking at some of the old posts and this made me wonder.. if someone is single with a health issue, not necessarily a disability, are they allowed to hire a maid?
I'm actually referring to myself, I have an illness that can potentially be life threatening if I live alone and throw a fit. Don't want to get into details but I am considering to hire a maid in the future...

Has anyone ever tried the WC bars to find a DH? I mean for actual house chores?
At the very least,  you'd get someone who's pretty and flirty. And y'all both have an understanding what they do during their "off time".  Lol

Yes, I had a relative with complicated health issues and he lived alone. So he hired an Indonesian maid to look after him. She basically does all the chores, cooks for him, and lives in the apartment 6-7 days a week. Occasionally she would take a Sunday off, but most days she's there 7 days a week. Price was about $4700 a month since he's paying her extra for the weekends.

She did have to call the ambulance a few times when his health suddenly deteriorated. Overall she took really good care of him.

Extended time off is just 2 weeks off for her to visit her family in Indonesia, and the agent could provide a temp maid during that time. My relative was also responsible for one return flight every 2 years, since the maid has to leave HK every 2 years IIRC.
